The certificate of character in this case is so bad that it would be almost impossible to pass it over; & I think the case in test held by our general rule that when an officer is degraded & not reinstated, his pension should be based on the pay to which he is reduced. In this case he only continued to serve for 4½ months after his reduction.
The average salary, the punishment becomes very light. I would only sanction $48, & tell him so.
Du Vernet that the 18th clause of the pension minute should not have been overlooked.
